In an article on page 2452 of issue 678 of this journal, we had the occasion to offer some commentary on the Decision of the Directorate-General of Registries and Notarial Affairs of 16 January 2002 concerning a registrar's refusal to register a deed declaring new construction and the creation of a horizontal property scheme because the development license required by Royal Decree 1093/1997 of 4 July, article 53.a), was not a matter of record. After the publication of Act 8/2007 of 28 May on state land and the subsequent revision that is now the law in force, it appears that some of the objections the Directorate-General has been raising in connection with whether licences are required for horizontal divisions of single- family homes may become unfounded. This is the issue addressed in this article.
