Abstract

In practice the issue of estate distribution can cause a raft of family conflicts if the persons with a stake in the estate cannot agree. This paper offers a few considerations about undivided estates, aimed at achieving a consistent, appropriate partition according to law. Several court rulings are cited and examined to help gain an understanding of how partition should be done, what operations it entails, what effects it has and what can make a partition invalid.
