Abstract

This paper is a study of the consolidation of registered rights as a cause of cancellation of registration. Specifically, it analyses the consolidation of rights as the cause of the annulment of real rights and therefore as grounds for cancellation of registration. The paper addresses the problem of whether such cancellation is a case of automatic cancellation under article 82.2 of the Mortgage Act and whether this is compatible with the request filed by an interested party. Lastly, the paper examines the correct way of performing such a cancellation and the proper sort of entry to be made to reflect the cancellation.
