APUNTES SOBRE LOS ELEMENTOS REALES DEL FENÓMENO SUCESORIO: EL SUPUESTO DE LOS TÍTULOS NOBILIARIOS COMO DERECHOS SUSCEPTIBLES DE SER TRANSMITIDOS POR TESTAMENTO Y SU REVOCACIÓN E INTERPRETACIÓN.

Abstract

The best doctrine lists, for educational purposes, three types of components that make up an estate. «The personal element» is what is dealt with when affairs are discussed referring to the decedent or the successor; next there are «elements of form», which pertain to the inheritance document and, where applicable, the acceptance of the estate. Lastly, there is «the real element», or the static view of the estate, made up of the set of property and rights that may be inherited. Along these latter lines, we will sum up the basic issues concerning the contents of the will and the interpretation of its terms when the will contains provisions concerning the transmission of the decedent's titles of nobility. This will be done in the light of Act 33/2006 of 30 October on the equality of names and women in the order of succession to titles of nobility and the recent line of Supreme Court jurisprudence.
