The purposes of harmonisation or unification European Private Law have focused essentitlly in the area of Contracts Law. However, the need to include the reals legals effects of obligatory relation it has become apparent to the problems of legal certainty that its failure could result, especially in the field of transfer of property. Therefore, many voices are now, at which also the European institutions, suggest the need to expand a bit more content Common Frame of Reference, in the light of the arguments and initiatives in this respect of researchers and studiouses in the field. It is therefore essential to include the property right, both movables and immovables, and especially the legal model and purposes of its transfer, even aware of the various transferability systems in force in member states of the Union Europe. But a look at the historical origins of the rules on the transfer of property and real effects in the current practice of law for procure of legal certainty, it could facilitate a meeting point for unification.
