Abstract

The Supreme Court's plenary ruling of 21 January 2010 inclines toward the thesis that the dies a quo for calculating extinctive prescription in cases of acts of unfair competition of continuing duration does not begin until the conclusion of the unlawful conduct. This thesis has been supported by the new version of article 35 of the Act on Unfair Competition, reworded under Act 29/2009.
