Abstract

This study deals with jurisdiction in matters relating to insurance (Section 3, Council Regulation, núm. 44/2001 of 22 December 2000). That Section establishes different rules of jurisdiction aimed at protecting the weaker party (the policyholder, the insured or a beneficiary). The provisions of this Section may be departed from by an agreement, but only limited autonomy to determine the courts having jurisdiction is allowed in insurance contracts. For instance, when it allows the weaker party to bring proceedings in courts other than those indicated in that Section.
