In the display for sale of products that violate trademark rights due to imitation or confusion of their distinctive signs, an implicit [reputational-moral] damage is derived that does not need further proof, so it is not necessary for the defendant to have obtained benefits with its commercialization so that it is compensable, as established by the Supreme Court, in a judgment of July 13, 2023.
