Abstract

The jurisprudential doctrine of recent years concerning all the issues closely concerning emancipation is reviewed. The essence of emancipation is the assignment to a minor by his or her parents or guardians of most of the minor's civil faculties and rights, i.e., the advancement by a few years of the termination of patria potestas. Nevertheless, the importance of the concept is quite devalued. Emancipation is primarily used as a differentiating criterion in parental marital crises, for the purpose of assigning maintenance obligations or the right thereto among relatives. There are also cases where emancipation is used to put an end to difficult family situations.
