JURISDICCIÓN VOLUNTARIA Y REGISTRO DE LA PROPIEDAD (BREVES CONSIDERACIONES SOBRE EL RÉGIMEN INSTITUIDO POR UNA REFORMA FRUSTRADA).
Keywords:
VOLUNTARY JURISDICTION, LEGISLATIVE REFORM, LAND REGISTERSAbstract
This essay carries out an analysis of the unsuccessful 2007 Voluntary Jurisdiction Bill from the Land Registry Office point of view. The essay is divided into two different parts. Starting from the currently applicable laws, in the first part an approach to the legislative and parliamentary processing of the unborn Voluntary Jurisdiction Bill is taken. Focused specifically on the registry system, the second part examines the attribution of competences on processing and resolution of various voluntary jurisdiction proceedings to the Land Registers, to end up with a short reference to the controversial rule contained in the Voluntary Jurisdiction Bill dealing with the object of the notary public faith. Even though it could seem this is an untimely essay, however, it is a critical analysis about how the registry voluntary jurisdiction should be done on the grounds of the latest legislative proposal.
