The vicissitudes generated by the appropriate combination of two principles of constitutional scope, the best interests of the child and the right to housing, in addition to being potential issues of eventual recreation of conflicts linked to family law, usually lead to situations in which the search for judicial solutions must put into play the value of excellence, which must not be anything else, in this area, than the application of normative criteria that contribute to the search and realization of principles of material justice. With the aim of identifying these principles and their jurisprudential application, this research work is written.
