Abstract

This paper is devoted to analyzing whether presumption of causation under article 1277 of the Civil Code is applicable or not in the sphere of registration law. The features of the presumption of causation are listed, and the postures in favour and against its application in the registration system are then examined. A conclusion is drawn concerning the need for the cause of registrable acts to be stated always, for the cause is the backbone of the principles of registration. Cause is the hub around which the principles of registration are structured, and it must always be known to and scrutinized by the registration authorities.
