Abstract

The Valladolid Provincial Court (Section 1) Judgment of April 11st 2006 resolves an interesting case where, after a notarized open testament, is made by the testator a handwritten testament in which she modifies the heir designation, although subject to the circumstance of «if an accident happened to me». Following this particular judgment, in this article we study the legal regime existing in case of carrying out several successive testaments by the same testator, and which is the relationship between them, especially the possible existence of a tacit revocation, making also a brief comment on it.
