Abstract

The global mortgage came into being as a new variety of mortgage under Act 41/2007 on Mortgage Market Reform. This paper looks at the origin of global mortgages and their evolution in case law up to the time of their recognition by law. This is followed by an analysis of the legal requisites for the creation and registration of global mortgages and a scrutiny of the changes and new turns global mortgages have experienced in the four years since their legal approval. There is some concluding discussion of what the current role of global mortgages is and whether they are living up to the expectations under which they were created.
