LOS ANTISUIT INJUCTIONS (MEDIDAS CAUTELARES ANTIJUICIO) EN DERECHO ESTADOUNIDENSE.

Abstract

The antisuit injunctions have being used in the US Law for a long time. This provisional remedy is known in the Spanish Law due to the international arbitration and the recognition of this remedy when it is issued in foreign proceedings. The main purpose of this provisional remedy is to avoid vexatious litigation. Due to the comity principle, the antisuit injunctions are orders to the parties of the proceeding for not initiating or continuing with a vexatious litigation. But this provisional remedy has to be issued cautiously in order to avoid undue interference with the other proceedings.
