Abstract

Two recent Spanish Supreme Court rulings have cleared up cases of damages caused by the omission of essential information in drug package inserts. This paper discusses the current state of pharmaceutical liability in Spain. There is a great deal of dispute over the subject, a good reason to analyze how drugs and medical devices are regulated and what kind of damage drugs do, or may do, to the people who take them. Accordingly, we will take a close look at the different legislative reforms and other court rulings on civil liability for pharmaceutical products.
