Abstract

The court ruling of 28 September 2012 accepts the extraordinary usucaption of shares in a public limited company through exercise of shareholders' rights for more than six years, even when the rules on proxy-giving and share transfers have not been respected, which is necessary for the treatment of usucaption because of the legal nature of shares in a limited liability company.
