The European Court of Justice's recent judgment of 14 March 2013 has serious implications for Spanish law. The judgment and the legislative changes that must be made because of it are examined. Special attention is paid to Spanish case-law after the judgment, which applies the new doctrine, as there is a clear need to harmonise jurisprudence based criteria of interpretation. The Spanish National Council of the Judiciary held a workshop to study the judgment; its conclusions are given here. Lastly, the legislative changes already passed and now in force are reviewed. These changes were introduced only recently, in Act 1/2013 of 14 May on measures to reinforce the protection of mortgage borrowers. A critical, constructive perspective is taken throughout the article.
