Abstract

The authors argue foreclosure proceedings that the before a notary does not conform to the Constitution and to the European Union Directives, are unfair and contrary to preventive legal security system, so they reduce the power of review by the land registrar. On the other hand argue that in case of assignment of mortgage credit, the execution can only encouraged by the assignee of having registered their right mortgage, so that the transfer unregistered certification can not be issued.
