Abstract

Critical thought about the real estate mortgages in accordance with the previous reforms made based on the economic and social situation of that time. This study shows how there is not a problem with how the mortgage is structured, but rather other issues that have to be addressed in based contractual and social legislation. Due to many reasons, such as lack of debate and legal critical thought and economic and social pressure, it is not advised to revise the mortgage law at the moment, which would require a closer analysis. However issues to be addressed are exposed. No passive attitude can be expected from suffocated mortgagers. Regardless the content, which is showed in the research, some urgent measures need to be taken immediately. However, this study focuses on alternative measures that are already within our legal system, which should help clear the relationships between a creditor and a mortgager.
