Abstract

Usucaption is an ancient legal institution. The way in which usucaption is regulated in the Civil Code of Catalonia is quite different from the way in which it is addressed in the Spanish Civil Code, yet until very recently the latter was applied on a supplementary basis in Catalonia. This paper offers a commentary on and interpretation of articles 531-23 to 531-29 of the Catalan Civil Code, which address usucaption. The application of articles 35 and 36 of the Spanish Mortgage Act in Catalonia is also discussed.
