CONCEPT OF RELATIVES AND THE BEST INTERESTS OF THE CHILD

Abstract

The law grants the right of relatives regarding minors. The jurisprudence specified that children really are the ones who have this right for their own benefit. The judge will set the extension of the relationship right, depending on the nature of the relationship between the minor and the relative as it can vary in each case. It may be the case of a change of regime granted relationship at any time by the judge, granting a degree of flexibility, in favor of insider versus relative or even grandparent... in the best interests of the child. Or, it may be that the right given to insider relationship is modified by the court after any fair cause to prevent it is found.
