CONTRACTUAL LIABILITY IN CASE OF DEATH BY ROAD ACCIDENT: A JURISPRUDENTIAL PERSPECTIVE

Abstract

This article aims to analyze the most relevant jurisprudence emerged regarding cases of compensation under the LRCSCVM, that the relatives of the victim should receive when he or she dies as a result of a traffic accident. Specifically, we will focus on the analysis of the most controversial cases, in which it is debated whether this right exists. Likewise, a comparative study is made about the new draft law for the reform of the system for the assessment of the damages caused to people in traffic accidents, April 10, 2015.
