Abstract

In this Study, we will discuss which legal text should regulate the single room lease contracts. Should they be regulated by the urban tenancy act or on the contrary is it a civil code issue? To figure out this question, we will analyze the intention of the legislator when he drafted the urban leasing act and, from this point of view, we will study the indeterminate juridicial/legal concepts that generate different types of doubt and interpretations on the subject. Furthermore, we will also examine from a critical perspective, the limits of the doctrine published on the issue and the existing jurisprudential currents on the subject to this day.
