Abstract

This article invites us to reflect on the public faith in registration and the property rights in the case of real estate fraud (falsification of documents or identities theft). In Perú, there are two positions that seem to be irreconcilable. On the one hand, those who defend the public faith in registration above the property rights; and, on the other hand, those who defend the property rights above the public faith in registration. It is important to assume one of the two positions in this confrontation, because only from the academic discussion will be possible to find an effective solution to this problem.
