Abstract

This paper tries to analyze, from a critical point of view, the judgment 97/17 of the Court of first instance núm. 3 of Marbella, which absolves the defendant of a possible illegitimate intrusion into the claimants right to honor. This acquittal is based on the fact that phrases such as «son of a bitch» are protected by the right to freedom of expression when addressed to a politician.
