Abstract

This  paper  aims to  analyse   the  revocation on  preferential  pay- ments made   by  the  debtor  to  banks in  order  to  break  the  principle of  equality among creditors. If  it  is shown that  the  transaction carried  out  during  a certain period  while  the  debtor  was  insolvent infringes the  par conditio creditorum, then the  trustee   could   avoid  such payment and  recover  the transferred  asset  for  the benefit  of the  estate.
