Abstract

This  paper analyzes the evolution of the concept of consumer in European and  Spanish  legislation and  jurisprudence. Special  attention is  paid  to the controversial cases of dual-purpose contracts and the situation of nondebtor guarantors and  mortgaging guarantors. After this  analysis, we observe  the tendency to  resort  to  a functional criterion in  the  assessment of  the  concurrence or not  of the  condition of consumer.
