Abstract

This report aims to demonstrate that article 36 of the new National Coast Regulation approved by Royal Decree 876/2014 of 10 October is illegal, because it bars or restricts registration for all entries, caveats, cancel- lations and marginal notes that should be set down on the folio for properties that have previously undergone initial registration; because it is incompatible with civil law, particularly registration law; and because it is not covered by the Coast Act. Therefore, it cannot be applied without serious detriment to the quality of the Spanish registration system.
