Agreements in anticipation of marital breakdown: legality and content

Abstract

Agreements in anticipation of marital breakdown allow the spouses to regulate  patrimonial and  personal aspects derived  from  their  eventual matrimo- nial  crisis.  Accepted  their  validity in  the  autonomous civil  law,  this  is not  the  case in  the  Civil  Code; however, this  has  not  been  an  obstacle  to its  recognition by our courts, which has  fixed  their  areas  of  validity as  well  as  the  limits of  the  clauses included in  the  agreements.
