Abstract

Up to the present in the traditional exchange of solar in exchange for future work, the inclusion of a pact including the condition resolutory expresses, in the case of non-compliance with the provision by the transferee, has been a formula, agile and effective to guarantee those who are deprived of their property without obtaining at least initially, the benefit that is due in exchange. However, the traditional swap has been overtaken by other formulas that allow greater flexibility and negotiation margin between the parties, such as the transfer of land, or common input and sharing. However, we propose again the formula of the cession of the urban development, which is perfectly assimilable, and we understand it can be very effective for the purpose to which it is oriented in this contract, being able to be guaranteed also with the express resolutory condition.
