Interpretation of the will of the testator when there has been a change of circumstances

The Supreme Court has given a jurisprudential draft to the questions on the interpretation of the will of the testator after his death so much in the supposition in which in the moment of the opening of the succession the spouses were divorced, as in the supposition in which the unmarried couple of the existing testator in the moment of grant of the testament, it is not when the causer dies and the opening of the succession takes place. In both suppositions there has taken place a change of circumstances that give place to the disappearance of the determinant motive for which the testator did in his day the testamentary disposi- tion, and consequently the same one is considered to be ineffective. Into the first case for the divorce that originates the matrimonial dissolution, and, in the second supposition, where the transcendent thing for the testator was that the legataria was his pair, the extinction of the user-friendly relation turns in ineffectively the testamentary disposition.
