Abstract

The harmonious, complementary and non-exclusive relationship between Roman law and Aragonese civil law must be understood as a commitment and proposal currently in force with a projection to the future, even though, traditionally, Aragon is considered to have constituted a refractory bastion against law Roman.

We cannot ignore the interrelation between Roman and canonical rights in the High Middle Ages as a harmonious expression of European legal culture and an exponent of the basic identity of the ethical-social order, to which we must add the important and decisive role of Observances in the history and preparation of Aragonese law, since through them it is possible to preserve, interpret and clarify it, thanks to the work of the lieutenants of the Justica de Aragón, seasoned Romanists educated under the medieval spirit of the School of Bologna.
