Abstract

When a case of abandonment of a minor or legally incompetent person is brought before a court and the rules of ordinary guardianship cannot be applied, the court will automatically award guardianship to a public entity. Following the rule of immediate legal process, the court will alter the ordinary order of candidacy for guardianship and appoint a public entity as guardian, when foundations do not include the exercise of guardianship among their official purposes or do not have the necessary economic resources.
