On 1 March 2011, the Court of Justice of the European Union (Grand Chamber) declared in Case C-236/09 that article 5(2) of Directive 2004/113/EC allowing the Member States freedom to establish sex-differentiated premiums and benefits was invalid. Premium-calculating mechanisms that factor in sex will be void as of 21 December 2012. This rate policy will probably cause a spike in premiums, which will require the amendment of Spanish insurance legislation.
