Abstract

The Supreme Court Judgment of 17 June 2026 held that the statutory subrogation regime laid down in Article 27 of the TRLSRU, applicable to the transfer of properties located within an area subject to urban development proceedings where the urbanisation works have not yet been completed, is not limited to the new owner of the land, but also extends to the purchaser of apartments and commercial premises in a completed building. This, in turn, means that, where the urban development is carried out under the compensation system, such purchaser must necessarily become a member of the relevant Compensation Board.
