International pledge of shares, international jurisdiction and precautionary measures in the Order of the Provincial Court of Madrid of October 31, 2025

In the Order of the Provincial Court of Madrid of October 31, 2025, precautionary measures requested in Spain in relation to an international pledge of shares were dismissed due to lack of international jurisdiction, given that the pledge agreement was subject to the laws of Luxembourg, and the parties to the pledge agreement had submitted to the Courts of the City of Luxembourg for all disputes that might arise from the pledge agreement, which must be analyzed under the applicable regulations and jurisprudence, regarding the correctness of said decision.
