This study, conducted within the research framework of Civil and Family Law, examines the legal regulation of the correction of errors in Cuba and its impact on citizens. Its main objective is to assess the principal legislative shortcomings of the Cuban procedure for correcting errors in Civil Registry records, which affect the processing of applications submitted by citizens. To this end, a comparative legal analysis is undertaken, drawing on the legal systems of Spain, Colombia, and Venezuela in order to examine the main regulatory frameworks governing this procedure and the legal treatment afforded to it. The study identifies those elements that may serve as useful references for improving due process, as well as the interpretation and application of Cuban legislation in this field.
The research also provides a historical, doctrinal, and legal analysis of the procedure for correcting errors in Cuba. It examines the applications processed by the Civil Registry Office and the cases heard by the Municipal People‘s Court of Puerto Padre between 2020 and 2024, based on a review of administrative case files and judicial decisions. This analysis makes it possible to assess the effectiveness of the applicable legal framework, particularly regarding the time required to process such proceedings and their impact on citizens.
To achieve these objectives, the research employed observational, historical-logical, legal-theoretical, exegetical-analytical, and comparative legal methods, supported by research techniques including surveys and interviews.
