Abstract

This study analyses the evolution of the jurisprudential dialogue between the Court of Justice of the European Union and the Supreme Court regarding the transparency and unfairness of IRPH clauses in mortgage loans. The analysis focuses in particular on the judgments of the Plenary Session of the First Chamber of the Supreme Court of 11 November 2025 (SSTS 1590/2025 and 1591/2025), which establish a structured methodology for transparency control and a technical comparative method for assessing unfairness.
